Welcome to Evergreen Office Spaces Ltd. (“Evergreen,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our website, evergreenofficespaces.com (the “Site”), and the purchase of products from our online store (the “Services”). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, you should not use our Site or Services.

  1. ELIGIBILITY
    You must be at least 18 years old to make purchases through our Site. By using our Services, you represent and warrant that you meet these eligibility requirements.

  2. ORDERS & PAYMENT
    - All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes and fees in your jurisdiction. 
    - We accept major payment methods as displayed at checkout.
    - Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including pricing errors or suspected fraudulent activity.

  1. SHIPPING & DELIVERY
    - Shipping and delivery timelines are estimates and may vary. We are not responsible for delays caused by carriers or circumstances beyond our control.
    - Customers are responsible for providing accurate shipping information. Additional charges may apply if items are returned due to incorrect or incomplete addresses.
    - Some items may require special delivery arrangements; customers will be notified if this applies.
    - Customers are responsible for ensuring safe and reasonable access to the delivery location. If delivery cannot be completed due to lack of access or inability to contact the customer, additional delivery charges may apply.
    - Delivery fees are non-refundable once delivery has been completed, as these costs are incurred at the time of service.

  1. RETURNS, REFUNDS & CANCELLATIONS
    - Please refer to our Return & Refund Policy for detailed information.
    - Certain items (such as final sale items, custom orders, or gift cards) may not be eligible for return or refund.
    - A 5% handling/restocking fee may apply to returns, refunds, or order cancellations.

  1. PRODUCT INFORMATION & CONDITION

    - We strive to display product details as accurately as possible. However, we cannot guarantee that colours, dimensions, or descriptions will be exact due to variations in monitors, materials, or product updates.
    - Many items may be pre-owned, refurbished, or used. Product conditions will be described to the best of our ability, but customers are responsible for reviewing descriptions before purchase.

  1. USED GOODS 
    Most items sold by Evergreen are pre-owned, refurbished, or used. As a result, normal signs of wear may be present. While we aim to describe condition accurately, minor variations should be expected.
  2. INSTALLATION/SERVICE 
    Where installation or delivery services are provided, customers are responsible for ensuring the space is ready and accessible. Evergreen is not responsible for delays or additional costs resulting from site conditions or access limitations.

  3. DAMAGES & ISSUES
    Items must be inspected on delivery or pickup. Any issues with defects, damage, or incorrect items must be reported immediately so we can evaluate and resolve the issue in a timely manner.

  1. INTELLECTUAL PROPERTY
    All content on the Site - including text, images, logos, graphics, and design - is the property of Evergreen Office Spaces Ltd. or its licensors. You may not copy, distribute, reproduce, or use our content without prior written permission.

  2. LIMITATION OF LIABILITY
    To the maximum extent permitted by law:

    - Evergreen is not liable for indirect, incidental, or consequential damages arising from your use of our Site or Services.
    - Our liability is limited to the amount you paid for the product giving rise to the claim.

  1. INDEMNIFICATION
    You agree to indemnify and hold Evergreen harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Site, violation of these Terms, or infringement of any rights of another.

  2. PRIVACY
    Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.

  3. GOVERNING LAW
    These Terms shall be governed by and construed under the laws of the Province of British Columbia, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts located in British Columbia.

  4. CHANGES TO THESE TERMS
    We reserve the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.
